The following Terms and Conditions (“T&C”) shall apply to the purchase of Goods and/or delivery of samples from Niro Ceramic Sales & Services (M) Sdn. Bhd. (“the Company”) by you (“the Customer”) via the Company's website to the exclusion of all other terms and conditions which the Customer may purport to apply under any purchase order, confirmation of order or any other similar document.

Please read these T&Cs carefully and make sure that you understand them, before ordering any Goods or samples from the Company's website. Please note that before placing an order you will be asked to agree to these T&Cs. Please click on the button marked "I Accept" at the end of these T&Cs if you accept them. If you refuse to accept these T&Cs, you will not be able to order any Goods from this website. You should print a copy of these T&Cs for future reference.

These conditions shall not be varied except by the agreement in writing of the Company.

Definitions:

'Goods' means the Goods, tiles or other products which the Customer orders from the Company.
'Price' means the price for the Goods excluding (where applicable) delivery charges, packing and insurance.
'Working Day' means Monday to Friday inclusive, but excluding Malaysian national public Holidays and the Company's closures as specified on the Company website.


1. Description of Goods

1.1 All descriptions, specifications and advertising on the Company website are for the purposes of giving an impression of the Goods only and cannot be relied upon for selecting a purchase. Any typographical, clerical or other error of omission in any sales literature, quotation, price list, acceptance of offer, invoice or other document or information issued by the Company shall be subject to correction without any liability on behalf of the Company.

1.2 The Company operates a sample policy as set out below to assist the Customer.

1.3 The Company work hard to achieve as close colour accuracy as possible in photographic material, however it is impossible to ensure total accuracy. A sample is always advised.

1.4 Goods are subject to shade variations within the manufacturing process. The Company cannot guarantee to match shades of previous orders (including sample orders).


2. Ordering and Supply of Goods

2.1 Minimum order per transaction is MYR1,000.00 nett and above.

2.2 Orders will be supplied to the nearest full tiles above the requested square meter or square feet. The Customer’s order will be automatically adjusted upwards to nearest carton.
 
2.3 As the number of tiles per square meter or per square feet is nominal, the Customer will be responsible for ensuring sufficient quantity of Goods are ordered to cover the required area.

2.4 Orders are accepted and promises for delivery are given conditionally upon the Company being able to secure the necessary material. The Company cannot be held responsible for delays arising from risks and uncertainties of stocking, manufacture, strike, accidents or other causes beyond the Company's control.

2.5 The Company cannot, under any circumstances, entertain any financial demand from the Customer for late or incorrect delivery. The Company always recommends that the Customer never book a tile installer until the Customer has the Goods delivered.

2.6 The Company will not however be responsible for compensating the Customer for any other losses that the Customer may suffer if the Company are unable to supply the Goods for any reason.


3. Samples

3.2 Free samples are supplied for the standard collection for the size of 100x100mm.

3.3 Delivery or postage of samples will be charged at MYR9.60 per single delivery and a maximum of five (5) samples can be requested for each delivery.

3.4 If more than one (1) sample of the same tile item code is ordered, the Company reserves the right to send only one (1) sample of that tile in the delivery.

3.5 For any of the mosaic or decorative tile, the Company will not provide any sample and if the Customer needs a sample, the Customer may order and pay for them at the normal price as indicated in the website.

3.6 Because samples are cut to order they are not refundable. At the time of delivery the Customer will be given a discount code for MYR9.60 off when the Customer places a minimum order of MYR1,000.00 nett. The order does not need to be for the same tile as the sample.

3.7 Delivery of free samples will be dispatched by Nationwide Express Courier Services Berhad to Customer’s doorstep without any notification from the Company.


4. Delivery

4.1 Please see our Delivery page for costs and details.

4.2 Goods will not be left unattended at an address. They must be signed for at the shipping address entered at checkout.

4.3 If Goods cannot be delivered due to the Customer's unavailability, they will be returned and the Customer will be liable for both the initial delivery charges and the full re-delivery charges.


5. Faulty/Incorrect/Defect/Broken Items

5.1 Unfortunately sometimes defect and mistakes do happen. Whatever the issue, the Company will do our best to ensure that issues are resolved to the Customer's satisfaction.

5.2 Incorrect/defect items must be noted at the time of delivery and documented on the driver's paperwork (proof of delivery) and the Customer should notify us within three (3) working days. Following this we will replace the items as quickly as possible at our cost. The Company may ask for photographic evidence and\or arrange return of the defect items.

5.3 Due to the nature of the Goods, it will be deemed acceptable if there are one (1) or two(2) broken Goods and the Company recommend that the Customer may use them where cuts are necessary.

5.4 Full cancellations of partially defect orders will be subject to the Company standard returns policy below.

5.5 Claims for incorrect, wrong colour or shade or defect Goods that have been fixed or otherwise used will not be considered. The Customer must ensure that Goods are to the Customer's satisfaction and suitable for use prior to fixing.


6. Payment

6.1 Goods will only be dispatched once full payment has been processed.

6.2 While the Company will try and ensure that all prices on the website are accurate, errors may occur. If the Company discovers an error in the price of Goods the Customer has ordered, the Company will inform the Customer as soon as possible and give the Customer option of reconfirming the order at the correct price or cancelling it.

6.3 The Company accepts most major credit cards.

6.4 All payments are processed by iPay88 (Mobile88.com Sdn. Bhd.), using secure https communication in line with the terms and conditions set by iPay88 (Mobile88.com Sdn. Bhd.).

6.5 The Company never stores the Customer’s credit card details on the Company’ servers.


7. Liability

7.1 The Customer becomes the owner of the Goods once paid for and delivered. Goods will be held at the Customer own risk. The Company will not be liable for their loss or destruction once risk has passed.

7.2 The Company must be notified of any transit damage to the Goods, shortage, or incorrect Goods supplied within three (3) working days with full details containing the product codes, quantity and defect condition.

7.3 The Company will only deliver to the address on the order and Goods will not be left without a signature.

7.4 If no-one is available to sign for the delivery, the order will be delivered at another time with any extra costs to be met by the Customer.

7.5 To the extent permitted by applicable laws, liability of the Company for direct loss and damages arising from the defective condition of any of the Goods supplied will not exceed the contract value of the Goods in respect of which the complaint is made, where such defects could not have been reasonably prevented by the Company.

7.6 To the extent permitted by applicable law, the Company will not be liable for any loss, damage, action, claims and liabilities whatsoever, including, without limitation, special, indirect, consequential damages or loss of revenue, howsoever arising in connection with the sale of Goods whether in contract, tort (including negligence of any nature and whether sole or concurrent)or otherwise, even if the Company has been advised of the possibility of such damage or loss.

7.7 Where any valid claim in respect of any defect in the quality or condition of the Goods, or their failure to meet specification is notified to the Company, in accordance with the T&C herein, the Customer is entitled to request for a replacement of the Goods or part of the Goods, and in the event the Company is unable to replace the Goods for whatsoever reason, the Company will refund the price of the Goods or a proportionate part of the price to the Customer. Where the claim was made in relation to any defect which could not have reasonably been prevented by the Company, the Company bears no further liability to the Customer after making the appropriate replacement or refund.

7.8 To the extent permitted by applicable law, the Company also disclaims any and all implied warranties of merchantability, fitness for a particular purpose, title and non-infringement.

7.9 To the extent permitted by applicable law, the Customer agrees that, in agreeing to this T&C, either it did not rely on any representations (whether written or oral) of any kind or of any person other than those expressly set out in this T&C or (if it did rely on any representations, whether written or oral, not expressly set out in this T&C) that it shall have no remedy in respect of such representations and (in either case) the Company shall have no liability in any circumstances otherwise than in accordance with the express terms of this T&C.


8. Delivery

8.1 Goods will only be dispatched once full payment has been processed.

8.2 Delivery of free samples will be dispatched by Nationwide Express Courier Services Berhad to the Customer’s doorstep without any notification from the Company.

8.3 Delivery of ordered Goods will be arranged by call contact with the Customer after two (2) working days of receipt of payment.

8.4 Goods ordered, where available, will normally be dispatched within mentioned working days in the chart below, excluding day of order and will only be delivered to the cardholder's registered billing address unless an alternative address is specified by the Customer and agreed with the Company. Time for delivery of Goods shall not be of the essence.

8.5 Delivery will normally be between Monday to Friday, 9.00 am to 6.00pm except Malaysian National Public Holidays and the Company's closures as specified on the Company website.

8.6 The Company provides unloading service up to car porch/main entrance (for landed property, ground floor only) and lobby (for condominium, apartment or any high rise buildings). Please ensure assistance is available at the site if the items need to be unloaded at the place other than the car porch and lobby. The Company reserves the right to charge for additional unloading requirements.

8.7 Any dates quoted for delivery of the Goods are approximate only and the Company shall not be liable for any delay in delivery of the Goods however caused. The Goods may be delivered by the Company in advance of the quoted delivery date.

8.8 If the Customer is not at the scheduled delivery site, the driver will not leave the Goods as there must be an authorised person to sign for and accept delivery.

8.9 If the Customer or the authorized recipients are not at site to receive the delivery as scheduled, there will be an additional deliver charges for the second call out.


9. Delivery Charges
9.1 Delivery charge for free samples is at the flat rate of MYR9.60 up to 5 samples within Peninsular Malaysia. Please contact our Customer Services at estore@nirogroup.com or +603 5033 9333 from Monday to Friday, 9.00 am to 6.00 pm for SAMPLES delivery outside Peninsular Malaysia.

9.2 For ordered Goods, we provide free delivery to coverage area for purchases MYR1,000.00 nett and above per transaction.*Check my area


10. Delivery Timeline

10.1 Delivery for FREE SAMPLES is usually within three (3) to five (5) working days after payment received.

10.2 All Goods will be delivered within the delivery lead time set.

10.3 The Company will contact the Customer two (2) days prior to the actual delivery date to confirm on the delivery details.

11. Cancellation Policy and Exchange & Return Policy 

The Cancellation Policy and Exchange & Return Policy will be applicable to the Customer's purchase of the Goods.

12. Severance
If any provision or part-provision of this T&C is or becomes invalid, illegal or unenforceable, it shall be deemed modified to the minimum extent necessary to make it valid, legal and enforceable. If such modification is not possible, the relevant provision or part-provision shall be deemed deleted. Any modification to or deletion of a provision or part-provision under this clause shall not affect the validity and enforceability of the rest of this T&C.

13. Governing Law
These T&Cs are governed by and construed in accordance with the laws of Malaysia.
